The Mashpee Wampanoag are negotiating for 90 more acres of land that includes frontage on Route 44 in Middleborough, tribe spokesman Scott Ferson confirmed last week. Coupled with the land already under agreement, the additional acreage, now owned by the KOA campground, would boost the tribe-owned total to 625 acres.

The luxury casino resort, which may include buildings as tall as 30 stories, would probably be concentrated in one place, with its sole access off Route 44.

'Questions have been raised about the size of the property, but tribe chairman Glenn Marshall has made it clear from the beginning the footprint [of the project] would be about 100 acres, and the rest of the land would serve as a buffer,' Ferson said in an interview last week.

Although the tribe will be bound by its agreement with the town, it can set up the casino with very little other government regulation, since their land will be considered sovereign Native American territory.

'The tribe is resistant, since it's sovereign land, to state or local oversight,' Ferson said. 'They are protective of their sovereign rights.'

The town's latest proposal for the casino agreement, sent to the tribe last Tuesday for its review, limits the maximum height of all buildings on the property to 345 feet, the height of the town's water tower. The height would allow for a building a little over 30 stories.

'I translate concern in town over the height of the building to be concern over the sight line,' Ferson said. 'People are concerned over what they'll see from their homes.

'But putting a 10,000-foot building in a hole or putting it on a 10,000 foot hill are two different things,' he said. 'We won't know where the building will be sited until the footprint of the parcel is in place.'

The tribe's review of the town's 36-page proposed agreement, which includes a quarter of a billion dollars in infrastructure improvements, may conclude this weekend, and a Wampanoag spokesman may be able to comment publicly on it as early as tomorrow.

Whatever deal the tribe and town officials negotiate will go to town voters in three weeks, at a Special Town Meeting July 28.

Town officials who favor a casino are scrambling to arrange for the session. Selectmen anticipate that as many as 10,000 voters may turn out.

But some say events are moving way too quickly to allow for serious deliberation.

'The Town Meeting itself is going to be a logistical nightmare,' said Selectman Patrick Rogers, who has not taken a stand on the agreement. The only location that is deemed large enough to accommodate the crowd of voters is Battis athletic field, he said.

Although Rogers said the draft proposal looks like a 'darn good deal for the town,' he added that he is still worried about the pace of consideration.
